Lytespeed Ping is an API monitoring service that allows users to monitor the availability and performance of their API endpoints. The Service includes:

• Monitoring of API endpoints for availability and response times
• Historical data tracking and analytics
• Alerts and notifications via Slack integration
• Dashboard and reporting features

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Monitor endpoints that you do not own or have explicit permission to monitor
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use the Service for any illegal, fraudulent, or unauthorized purpose
• Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks
• Use automated systems (bots, scripts, etc.) to access the Service in a manner that sends more request messages to our servers than a human could reasonably produce in the same period
• Transmit any viruses, malware, or other malicious code
• Collect or harvest any information from the Service

We strive to provide reliable service, but we do not guarantee that the Service will be available at all times or that it will be free from errors, defects, or interruptions. We reserve the right to:

• Modify or discontinue the Service (or any part thereof) at any time with or without notice
• Perform scheduled and unscheduled maintenance that may temporarily interrupt the Service

We are not liable to you or any third party for any modification, suspension, or discontinuance of the Service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LYTESPEED, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater. This limitation applies regardless of the legal theory on which the claim is based.

You agree to indemnify, defend, and hold harmless Lytespeed and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your content caused damage to a third party.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and all associated data
• All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability

You may terminate your account at any time by contacting us or through the account settings in the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
